§ 1Overview
These terms apply to the use of the Baixian Trade website at trade.baixiangroup.com and any associated subdomains. By browsing or otherwise engaging with the site, the visitor accepts these terms as the basis on which the site is made available.
The terms below cover the relationship between this site and its visitors: how the content of the site may be used, what is and is not permitted, and how the site is governed. They are distinct from the trade terms that govern any actual sale, processing, storage, or service contract concluded between Baixian Trade and a commercial counterparty. Those trade terms are agreed in writing as part of the specific contract for the transaction concerned, and prevail over anything on this site to the extent of any inconsistency.
§ 2About Baixian Trade
This site is published under the Baixian Trade name — the trading arm of Baixian Group (百鮮集團), a group of affiliated companies operating from Kaohsiung, Taiwan, with manufacturing and logistics operations on both sides of the Taiwan Strait. In these terms, "Baixian Trade", "we", and "us" refer to the trading operation conducted under that name through the group's affiliated companies. The specific entity responsible for any given commercial transaction is identified in the contract for that transaction.
§ 3Using this site
This site is intended for use by commercial counterparties, prospective counterparties, journalists, regulators, and other readers with a legitimate interest in our trade, research, and operating practice. Visitors are expected to use the site in good faith and consistent with that intent.
Activities outside that intent are not authorised, including:
- Automated retrieval at scale — scraping, crawling, or otherwise extracting site content at a volume beyond ordinary browsing, including for the purpose of redistribution, training datasets, or competitive intelligence gathering, except where expressly permitted in writing.
- Interference with the site — attempts to compromise the security, integrity, or availability of the site or any system connected to it, or to circumvent any access control.
- Misrepresentation — submitting information through the site under a false identity, or impersonating an authorised representative of Baixian Trade or any third party.
- Use to harm others — use of the site, its content, or its forms to harass, defame, defraud, or otherwise harm any person or organisation.
We may, without notice, restrict access to the site or to particular features in response to activity that appears inconsistent with the above.
§ 4Intellectual property
The text, photographs, charts, maps, video, design, and underlying code of this site are the property of Baixian Trade or its licensors. Baixian, Baixian Trade, 百鮮集團, the Baixian wordmark, and the Baixian brand mark are trade names and marks used by Baixian Group and its affiliates.
References to third-party names or marks on this site appear in their ordinary descriptive sense — for example, when we name a regulatory body, a scientific data source, a port, or a market — and do not imply endorsement, affiliation, or any commercial relationship between Baixian Trade and the third party concerned.
Photographs of products, facilities, and operations are taken at Baixian Trade and group facilities, or are licensed from third parties. Their use outside this site requires prior written permission.
§ 5Published research
Material grouped under our Insights surface — including the Quarterly Outlook, Species Weekly Briefs, Special Reports & Forecasts, and the trade notes that accompany them — is commercial research produced by Baixian Trade for the use of trade counterparties and subscribers. We grant the following permissions for its use:
- Quotation — short quotations from our published material, with clear attribution to the publication title and to Baixian Trade, are generally permitted for the purposes of reporting, academic citation, or commercial reference. We consider quotations of up to approximately 150 words from a single publication to fall within this allowance.
- Internal use — subscribers and counterparties may reproduce and circulate our material internally within their own organisation for the purpose of informing the organisation's own commercial activity.
- Redistribution and republication — redistribution of our material outside the recipient organisation, republication in another publication, inclusion in commercial training datasets, or any use that would substantially substitute for direct access to our material requires prior written consent.
The cadence, scope, and content of our publications may change without notice. Where a publication is materially revised, the version available on this site is the version we currently stand behind, and previous versions are superseded.
§ 6Forms and inquiries
The forms on this site — including the request-for-quotation form, the general inquiry form, the media inquiry form, and any subscription form — exist to allow visitors to initiate contact with Baixian Trade. Submission of a form does not in itself create a commercial relationship, a binding offer, or a contract of any kind.
Inquiries received through the site are reviewed by the team to which they are routed. We may respond, request further information, or decline to engage further, at our discretion. Information submitted through these forms is handled in accordance with our privacy policy.
§ 7No commercial offer
Nothing on this site is a binding offer to sell, a representation of currently available inventory, a price quotation, or a guarantee of capacity. Prices, currency references, freight references, specification descriptions, and operating metrics that appear on the site are reference only and are described further in our disclaimers.
Binding commercial terms are agreed in a separate, written contract between Baixian Trade and the counterparty concerned. Only such a written contract creates legal obligations between us in respect of a commercial transaction.
§ 8Third-party content
Where this site references, cites, or links to material produced by third parties — including regulatory bodies, scientific assessment authorities, currency data providers, mapping services, and external publications — those references appear for the reader's information. We do not control the underlying material, do not warrant its accuracy or freshness, and do not endorse it beyond the limited use that appears on our page. Further detail is set out in our disclaimers.
§ 9Limitation of liability
This site is provided on an "as is" and "as available" basis to the extent permitted by applicable law. We do not warrant that the site or any feature on it will be available continuously, free of errors, secure against all forms of attack, or fit for any particular purpose. We do not accept responsibility for the consequences of any reliance placed on the content of the site beyond the limited scope set out above and in our disclaimers.
To the maximum extent permitted by applicable law, Baixian Trade, its affiliates, and its officers, employees, and agents are not liable for indirect, incidental, consequential, special, or punitive damages arising out of the use of this site, even where the possibility of such damages was known or foreseeable.
Nothing in this section limits any liability that may not be limited under the applicable law of the jurisdiction in which the visitor is located.
§ 10Governing law and language
These terms are governed by the laws of Taiwan. Any dispute arising out of or in connection with use of this site, or these terms, is subject to the non-exclusive jurisdiction of the competent courts of Kaohsiung, Taiwan.
The English-language version of these terms is the authoritative version. Translated versions are provided for the convenience of readers; in the event of any inconsistency between the English version and a translation, the English version prevails.
§ 11Changes to these terms
We may update these terms from time to time to reflect changes in our practice, the operation of the site, or applicable law. When we do, the updated version replaces this one on the site. The version visible here is the version that applies to use of the site at the time of the visit.
